Hem62 cares a lot about your privacy and doesn’t do anything silly with your personal data. We therefore only process data that we need for (the improvement of) our services and are careful with the information that we have collected about you and your use of our services. We never make your data available to third parties for commercial purposes.

This privacy policy applies to the use of the website and the services provided by Hem62. The effective date for the validity of these conditions is 21/05/2018, with the publication of a new version the validity of all previous versions expires. This privacy policy describes what information about you is collected by us, what this information is used for and with whom and under what conditions this information may be shared with third parties. We also explain how we store your data and how we protect your data against misuse and what rights you have with regard to the personal data provided by you to us.

Webshop software

WooCommerce

Our webshop is developed with software from WooCommerce, we have chosen Antagonist for our webhosting. Personal data that you make available to us for the purpose of our services, will be shared with this party. Antagonist has access to your data to offer us (technical) support, they will never use your data for any other purpose. Antagonist is obliged to take appropriate security measures on the basis of the agreement that we have concluded with them. These security measures consist of the use of SSL encryption and a strong password policy. Backups are made on a regular basis to prevent data loss.

Webhosting

Antagonist

We receive web hosting and e-mail services from Antagonist. Antagonist processes personal data on our behalf and does not use those data for its own purposes. However, this party may collect metadata about the use of the services. This is not personal data. Antagonist has taken appropriate technical and organizational measures to prevent the loss and unauthorized use of your personal data. Antagonist is obliged to maintain confidentiality on the grounds of the agreement.

E-mail and mailing lists

MailChimp

We send our e-mail newsletters with MailChimp. MailChimp will never use your name or email address for its own purposes. At the bottom of every email automatically sent through our website you will see the ‘unsubscribe’ link. With this link you can unsubscribe from our newsletter and you will not receive the newsletter anymore. Your personal information will be stored securely by MailChimp. MailChimp uses cookies and other internet technologies that provide insight into whether e-mails are opened and read. MailChimp reserves the right to use your information to further improve the service and to share information with third parties.

Antagonist

We use the services of Antagonist for our regular business e-mail traffic. This party has taken appropriate technical and organizational measures to prevent abuse, loss and corruption of your and our data as much as possible. Antagonist does not have access to our inbox and we treat all our e-mail traffic confidentially.

Payment processors

Mollie

We use the Mollie platform to process (part of) the payments in our webshop. Mollie processes your name, address and location details and payment details such as your bank account or credit card number. Mollie has taken appropriate technical and organisational measures to protect your personal data. Mollie reserves the right to use your data to further improve the service and within this framework (anonymous) data with third parties. All the above guarantees regarding the protection of your personal data are also applicable to the parts of Mollie’s services for which they engage third parties. Mollie will not store your data for longer than is permitted by law.

Stichting Derdengelden Certo Escrow

For handling (part of) the payments of our accommodations, activities and packages we work with Stichting Derdengelden Certo Escrow. This foundation processes your name, address and residence details and payment details such as your bank account or credit card number. Stichting Derdengelden Certo Escrow has taken appropriate technical and organisational measures to protect your personal data.

Shipping and logistics

PostNL

If you place an order with us, it is our job to have your package delivered to you. We use the services of PostNL to carry out the deliveries. It is therefore necessary for us to share your name, address and place of residence with PostNL. PostNL will only use this information for the purpose of executing the agreement. In the event that PostNL engages subcontractors, PostNL will also make your details available to these parties.

Deutsche Post

For the shipment of parcels outside the Netherlands, we (sometimes) use the services of Deutsche Post to carry out the deliveries. It is therefore necessary for us to share your name, address and location details with Deutsche Post. Deutsche Post will only use this information for the purpose of executing the agreement. In the event that Deutsche Post engages subcontractors, Deutsche Post will also make your details available to these parties.

Billing and accounting

Moneybird

We use the services of Moneybird for our administration and bookkeeping. We share your name, address and location details and details regarding your order. This information is used to administer sales invoices and purchase invoices. Moneybird is obliged to secrecy and will treat your data confidentially. Moneybird does not use your personal data for other purposes than described above.

External sales channels

Bol.com

We sell (part of) our products through the Bol.com platform. If you place an order via this platform, Bol.com will share your order and personal data with us. We use this information to process your order. We will treat your data confidentially and have taken appropriate technical and organisational measures to protect your data against loss and unauthorised use.

Purpose of data processing

General purpose of processing

We use your data exclusively for the purpose of our services. This means that the purpose of the processing is always directly related to the order you give us. We do not use your data for (targeted) marketing. If you share information with us and we use this information to contact you at a later date, other than at your request, we will ask you for your explicit permission to do so. Your data will not be shared with third parties other than to comply with accounting and other administrative obligations. These third parties are all bound to secrecy on the basis of the agreement between them and us or an oath or legal obligation.

Automatically collected data

Data that is automatically collected by our website are processed for the purpose of further improving our services. This information (e.g. IP address, web browser and operating system) is not personal data.

Cooperation in tax and criminal investigations

In such cases, Hem62 may be required by law to share your data in connection with governmental tax or criminal investigations. In such a case, we are obliged to share your data, but we will oppose this within the limits of the law.

Storage periods

We will keep your data for as long as you are a client of ours. This means that we keep your customer profile until you indicate that you no longer wish to use our services. If you indicate this to us, we will also interpret this as a forgetful request. Pursuant to applicable administrative obligations, we must store invoices containing your (personal) data, so we will store this data for as long as the applicable period runs. However, we no longer have access to your client profile and documents that we have produced as a result of your order.

Your rights

Pursuant to the applicable Dutch and European legislation, as a data subject you have certain rights with regard to the personal data that are processed by or on behalf of us. Below, we will explain to you which rights these are and how you can invoke these rights.

In principle, in order to prevent misuse, we only send copies of your data to your e-mail address, which is already known to us. In the event that you wish to receive the data at a different e-mail address or, for example, by post, we will ask you to identify yourself. We keep records of completed requests; in the event of a forgetful request, we administer anonymous data. All transcripts and copies of data are sent to you in the machine-readable data format that we use within our systems.

You have the right to lodge a complaint with the Personal Data Authority at any time if you suspect that we are using your personal data in the wrong way.

You will then receive a response to your request within 30 days. If your request is granted, we will send you a confirmation that the details have been changed to the e-mail address we have received.

Right of limit processing

You always have the right to limit the data that we process (or have processed) in relation to your person or that can be traced back to you. You can make a request to us to that effect. You will then receive a response to your request within 30 days. If your request is granted, we will send you a confirmation at the e-mail address known to us that the data will no longer be processed until you lift the restriction.

Right of transferability

You always have the right to have the data that we process (or have processed) and that relate to you or are traceable to you, carried out by another party. You can make a request to us to that effect. You will then receive a response to your request within 30 days. If your request is granted, we will send you copies of all data about you that we have processed or have been processed by other processors or third parties on our behalf to the e-mail address we have known to us. In all probability, we will no longer be able to continue providing this service in such a case, as the secure linking of data files will then no longer be guaranteed.

Right of objection and other rights

If necessary, you have the right to object to the processing of your personal data by or on behalf of Hem62. If you object, we will immediately cease processing the data pending the outcome of your objection. If your objection is well-founded, we will make available to you copies of data that we process (or have processed) and then permanently cease processing.
